Hire Services

Finality of Booking
All hire service bookings are final and non-refundable once confirmed. This includes, but is not limited to, equipment hire, venue hire, and entertainment services. By making a booking, you accept these Terms and Conditions and acknowledge that no refunds will be issued under any circumstances.

Changes to Bookings
Changes to bookings can be made up to 14 days before the scheduled event, subject to availability and approval by QWERKY Events. Any changes requested after this deadline will not be accommodated, and no refunds or adjustments will be made.

Weather Policy
Weather-related cancellations or issues will not qualify for refunds or rescheduling. QWERKY Events cannot control weather conditions, and customers are advised to plan accordingly.

Damages to Equipment

• Customers are responsible for the care and safe return of all hired equipment.

• If the equipment is damaged, lost, or destroyed—whether due to accident, negligence, or weather-related events—the full cost of repair or replacement will be charged to the customer.

• QWERKY Events will issue an invoice for the damages, which must be paid immediately upon receipt.
  
  

Karaoke Private Hire

• A minimum of 10 attendees is required for private karaoke hire.

• If fewer than 10 attendees arrive for the booking, QWERKY Events reserves the right to refuse service. No refundswill be issued in such cases.
  
  

Liability Disclaimer
QWERKY Events accepts no liability for:

• Any issues arising from improper use of hired equipment by the customer or their guests.

• Delays, interruptions, or cancellations caused by external factors beyond QWERKY Events’ control.
  
  

Payment of Balances and Additional Costs

• All outstanding balances must be paid in full no later than 14 days before the scheduled event.

• Any additional costs incurred (e.g., damages, late changes) will be invoiced and must be paid immediately.
  
  

Customer Acknowledgement
By confirming a booking, you agree to these Terms and Conditions and accept full responsibility for the hired equipment and compliance with all stated policies.

Event Planning Services

Scope of Services
QWERKY Events provides event planning services based on the agreed scope outlined during the booking process. The scope may include, but is not limited to, venue arrangements, entertainment booking, equipment or prop hire, and event coordination. Any services or elements outside of the original scope will incur additional costs.

Changes to Services

• Changes to the event scope, schedule, or details can be requested up to 14 days before the event date.

• All changes are subject to approval by QWERKY Events and will incur additional charges, which must be paid immediately upon invoicing.

• Changes requested less than 14 days before the event will not be accommodated, and the original agreement will remain in place.
  
  

Weather Policy
QWERKY Events is not responsible for weather conditions or their impact on the event.

• Customers cannot cancel services due to weather-related issues.

• Full payment of the agreed services will still be required, and no refunds will be issued.

• Customers are advised to have contingency plans in place for outdoor events.
  
  

Damages and Liability

• Customers are fully responsible for any damages to props, equipment, or other items provided by QWERKY Events for the event.

• This includes damages caused by guests, attendees, weather, or accidents.

• QWERKY Events will issue an invoice for the repair or replacement costs, and payment must be made immediately upon receipt.
  
  

Non-Cancellable Services
Once confirmed, event planning services are non-cancellable. Customers are liable for the full payment of services, regardless of changes in personal circumstances, weather, or other unforeseen factors.

Payment Terms

• Full payment for services is due 14 days before the event date unless otherwise specified.

• Any additional costs incurred (e.g., last-minute changes or damages) will be invoiced separately and must be paid immediately.
  
  

Customer Acknowledgement
By booking QWERKY Events’ planning services, you agree to these Terms and Conditions and accept full responsibility for compliance. You acknowledge that QWERKY Events will not be held liable for any factors beyond its control, including but not limited to weather, attendee behavior, or third-party vendor performance.

Event Conduct

Zero Tolerance Policy
QWERKY Events maintains a zero-tolerance policy for any form of abuse, rudeness, or violence directed toward our staff, performers, or other attendees. This includes, but is not limited to:

• Verbal or physical abuse.

• Disrespectful or disruptive behavior.

• Harassment of any kind.

If you engage in any of these behaviors, you will be immediately removed from the event, and no refund will be issued.

Respect for Staff, Performers, and Attendees
All attendees are expected to behave respectfully toward QWERKY staff, performers, and other customers. This includes:

• Refraining from using offensive language or behavior.

• Complying with requests made by event staff for the safety and comfort of everyone.
  
  

Performer Interaction
Performers may interact with attendees as part of the show. However:

• This does not give you the right to touch, abuse, or harass performers unless they give explicit permission.

• If you do not wish to be touched or interacted with by a performer, you must clearly communicate this to the performer during the interaction.
  
  

Prohibition of Illegal Substances
The possession or use of illegal substances is strictly prohibited at all QWERKY Events. Attendees found with illegal substances will be removed from the event without a refund and may face legal consequences.

Media and Photography
By attending a QWERKY Event, you consent to the following:

• Photos, videos, and other media may be captured during the event.

• These images and videos may be used on the QWERKY website, social media channels, and printed media for promotional purposes.

If you do not wish to appear in any media, you may request removal by contacting us via email. Similarly, you may request copies of any images featuring you by emailing QWERKY Events directly.

Removal from the Event
QWERKY Events reserves the right to remove any attendee who:

• Violates the rules outlined above.

• Disrupts the event or poses a safety risk to others.

No refunds will be issued if you are removed due to your actions or behavior.

Acknowledgment of Terms
By attending a QWERKY Event, you agree to these Terms and Conditions and accept full responsibility for your conduct. Failure to adhere to these terms may result in immediate removal from the event and further action if necessary.

Cancellation and Moving of Events by Us (QWERKY)

Event Cancellation

• If QWERKY Events cancels an event, we will notify customers as soon as possible via the contact information provided at the time of booking.

• In the event of cancellation, a refund will be issued for the ticket price excluding the booking fee, which is non-refundable.
  
  

Changes to Events
QWERKY Events reserves the right to make changes to the event lineup, venue, time, or location at short notice.

• No refunds will be issued for changes that do not significantly alter the event experience, such as:

  • Adjustments to the performer lineup.

  • Minor schedule adjustments.

  • Venue relocations within a reasonable distance.
    
    

Event Relocation
In circumstances beyond our control, such as unforeseen venue issues, local restrictions, or emergencies, QWERKY Events reserves the right to relocate the event to an alternative venue.

• Every effort will be made to ensure the new venue is within a 20-minute radius of the original location.

• The relocation allows the event to proceed with minimal inconvenience, and no refunds will be issued for a change of venue.
  
  

Short-Notice Changes
QWERKY Events reserves the right to make changes or relocate the event with as little as three (3) hours' notice prior to the event start time.

• Customers will be notified as promptly as possible using the contact details provided during booking.
  
  

Right to Modify Events
QWERKY Events reserves the right to modify event details, including but not limited to the following:

• Event Time: The start time of the event may be adjusted by up to plus or minus four (4) hours to accommodate unforeseen circumstances.

• Event Details: Modifications may be made to ensure the event proceeds smoothly under unexpected conditions.

In all cases, QWERKY Events will make every effort to notify customers as soon as possible and ensure the modifications cause minimal disruption.

Refunds for Modifications

• No refunds will be issued for customers who cannot attend the event due to changes in time, venue, or other event details, unless explicitly agreed to by QWERKY Events.

• Refunds, if approved, will not include the booking fee.
  
  

Acknowledgment of Terms
By purchasing a ticket or booking with QWERKY Events, you agree to these Terms and Conditions. It is your responsibility to check for updates or communications from QWERKY Events regarding any changes to the event.

Liability

Venue Liability

• Responsibility of the Venue: QWERKY Events operates as an event organizer and facilitator. The venue owner or operator is solely responsible for the maintenance, safety, and security of the event premises.

• No QWERKY Liability: QWERKY Events shall never be held liable for any loss, theft, injury, or damages occurring at or around the event venue. Any incidents related to personal property loss, theft, or personal injury are the sole responsibility of the venue owner.

• Claims and Disputes: Attendees must direct any claims, disputes, or issues arising from the venue to the venue management. These matters fall under the venue's own public liability insurance and policies.
  
  

Limitation of Liability

• No Warranties: QWERKY Events makes no warranties or representations, express or implied, about the suitability, security, or safety of the event venue.

• Assumption of Risk: Attendees acknowledge and accept that attending events involves inherent risks, and they agree to assume all such risks associated with participation.

• Exclusion of Liability: To the fullest extent permitted by law, QWERKY Events excludes all liability for any direct, indirect, incidental, consequential, or special damages, including but not limited to:

  • Personal injury or death.

  • Loss, theft, or damage of personal property.

  • Any other unforeseen incidents occurring before, during, or after the event.
    
    

Indemnification

• Hold Harmless Agreement: By attending a QWERKY Event, you agree to indemnify, defend, and hold harmless QWERKY Events, its employees, agents, affiliates, and representatives from any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or connected to:

  • Your participation in the event.

  • Any violation of these Terms and Conditions.

  • Any acts or omissions by you that result in loss, damage, or injury to any party.

• Third-Party Claims: You agree to indemnify QWERKY Events against any claims made by third parties due to your actions or failure to act in accordance with these terms.
  
  

Personal Property

• Attendee Responsibility: Attendees are solely responsible for their personal belongings. QWERKY Events accepts no responsibility for any personal items that are lost, stolen, or damaged at the event.

• No Secure Storage: Unless expressly provided, QWERKY Events does not offer secure storage facilities at event venues.
  
  

Insurance

• Venue Insurance: All liability and insurance coverage related to the event premises are maintained by the venue owner. Attendees should refer to the venue's policies for details.

• Attendee Insurance: Attendees are encouraged to have personal insurance to cover any potential losses, damages, or injuries.
  
  

Limitations

• Legal Compliance: Nothing in these Terms and Conditions seeks to exclude or limit any liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence.
  
  

Acknowledgment of Terms
By attending a QWERKY Event, you acknowledge that you have read, understood, and agree to these Event Liability, Limitations of Liability, and Indemnification terms. You accept that QWERKY Events will not be held responsible for any incidents as outlined above.
